1. Buy-Sell Agreement
 

By placing an order you make us the offer to bind a contract with you.

After placing an order, you will firstly receive an order confirmation to your e-mail address. However, the purchase agreement is bound only when you recieve a written agreement confirmation to your e-mail address or with the delivery of your order.

You can place an order on our on-line shop by following these three easy steps:
  • Firstly, you select the items you would like to purchase and add them to the shopping cart.
  • Secondly, you provide your personal information, including billing and shipping address.
  • Finally, you choose the payment method for your order.
After following these three steps, you have the opportunity to review again all the information provided (such as name, address, payment method, selected items) and correct them if necessary before placing your order by clicking on the button "Send order'.

2. Storing the Buy-Sell Agreement
 
The Buy-Sell Agreement will be stored in our database. You can print this agreement on the last step of placing your order by clicking on the "Print Contract" button. We will also send to your e-mail adress an order and shipping confirmation with all the information regarding your order and a copy of our Terms and Conditions.

3. Claim of ownership OrthoDepot GmbH

The goods remain under the ownership of our company until we recieve the entire payment for them. 

4. Prices, Shipping and Return Costs
 
  • The prices from our catalogue don't include VAT. However, the corresponding VAT will be added on the invoices depending on the provenance of each customer.
  • Shipping Taxes with UPS delivery parcel:
             - European Union: Only 9,90 € or free shipping for purchases over 200,00 € net value.
             - Germany: Only 6,90 € or free shipping for purchases over 150,00 € net value.
             - For more specific shipping taxes regarding other European countries, please read our Shipping and Payment Conditions.
  • Customers who want to exercise their right of withdrawal will have to bear the return costs in those cases when the delivered goods correspond with the ordered goods and when the value of the returned goods does not overcome the amount of 40 €. Also for the goods that have not been paid yet by the time customers exercise their right of withdrawal. For all other cases such as wrong delivery or damaged goods the return process is free of charges.

5. Delivery 
  • OrthoDepot can not guarantee availability for all products listed on the website. Therefore, we reserve the right to deliver partially or to cancel an order for reasons such as temporary unavailability, limited edition, etc.
  • If the prices or other details regarding our products has been posted wrong on the website, we reserve the right to inform customers as soon as possible about these errors and to change or cancel the delivery of this specific product/s.
  • Unless otherwise indicated, the orders will be delivered within 2-3 working days after their shipping has been confirmed. The order confirmation recieved on e-mail right after orders have been placed is for informative purposes only. The definitve written confrimation will be sent either on e-mail or with the delivery of the order.
6. Terms of payment 

We offer the following payment methods: credit card, debit account, payment in advance or bank/wire transfer within 14 days after recieving the ordered goods (for orthodontis, dentists and clinics from Europe). In some cases, we reserve the right to exclude specific payment methods or ship the goods only after we recieve the payment.

7. Warranty 

Our products' warranty is in accordance with the statutory provisions. The purchased goods can be returned within the next 12 months as long as they are in their original packaging and can be resold, according to the european directive on medical products 893/42/EEC). If the customer is also the a consumer, the warranty period is one year.

8. Privacy Policy 

During development, conclusion and performance of the contract your data information provided will be collected, stored and processed in our data base in accordance with legal requirements. 

When you visit our website, the following data is colected: your IP address, date and time, browser type, operating system, and the pages you are logged on. Relate to personal data we are therefore not possible nor intended. Therefore, no personally identifiable data will be stored.

The personal information you provide us when placing an order or sending us an e-mail (at info@orthodepot.com), will be used only for contacting you and with the purposes for which you provided us this information. This will be shared only with the delivery parcel and the payment company we are working with.

Otherwise, no personal data provided wil be shared with third parties, unless we are legally forced to or you have previously given us your permission. As far as we cooperate with service providers in terms of procedres and handling of data processing, the contracts comply with the rules of the national data privacy legislation.

9. Duration of storage 

Personal information provided to OrthoDepot with purchase intentions will be stored in our database until the conditions of the Buy-Sell Agreement have been fullfilled. As far as periods for safekeeping relating to commercial law and according to tax law are to be followed, the duration of the storage of certain data can amount up to 10 years.

10. Customers' rights

If you no longer agree with the storage of your personal data or if the information is no longer correct, we will correct or delete it as long as the storage is not required by law. On request you will recieve free information about all personal data that have been stored about you. 11. Links to other web pages 

As far as we refer or link to third parties' websites, we can assume no warranty or liability for the accuracy or completness of the contents of their data privacy. We do not have any influence on the content used by these providers and their adherence to the data protection regulations. For this reasons, you should find out about the guidelines that apply to these websites when visiting them.


12.  Applicable Law and Jurisdiction 

German Law is exclusively applicable. The agreement on the applicable law applies only to customers whose protection is not revoked explicitly by laws of the state in which they have their habitual residence. If the customer is not the consumer, the agreed jurisdiction will be the Nürnberg (Germany).
